Renewed discontinuation due to statute of limitations in the case of driving ban
After the discontinuation of proceedings in February, we received another piece of good news.
Our client was initially accused of exceeding the speed limit by 67 km/h outside built-up areas, which was to be punished by the imposition of a two-month driving ban.
After the objection was filed and measurement data and other requested documents were again not made available, an application for a court decision was also filed here and justified in detail, which was partially positively decided by order of the Würzburg Local Court.
The Bavarian Police Administration Office then complied with the decision, but no further procedural steps were taken. As a result, the statute of limitations expired at the beginning of 2020 and the proceedings had to be discontinued accordingly.
