Successful defense in speed measurement: A violation becomes B violation – probationary period saved!
Initial situation
Our client, a young novice driver on probation, was confronted with a serious charge: He was accused of exceeding the speed limit by 22 km/h in a built-up area. As an “A” offense, this would have resulted not only in a severe fine, but also in an advanced training seminar and an extension of the probationary period – with considerable consequences for his future driving license.
Our strategy
After receiving the fine notice, we immediately lodged an appeal and commissioned a renowned expert in traffic measurement technology to review the speed measurement. The expert opinion revealed considerable deficiencies in the measurement:
- Obstacles in the detection area: grasses and delineators impaired the measurement
- Violation of the instructions for use: The obstacles should have been avoided
- Missing measurement series: Proper measurement operation could not be verified due to the missing measurement series
- Anomalies in the statistics file: Unusually long interruption after midnight
The result
Thanks to our consistent defense and the well-founded expert opinion, we achieved a decisive success: the local court reduced the speeding offence from 22 km/h to only 20 km/h.
The consequences for our client:
- Instead of 115 euros only 70 euros fine
- No longer an A offense, but only a B offense
- No advanced seminar required
- No extension of the probationary period
- Instead of 1 point in Flensburg: 0 points
Conclusion
This case impressively shows how important an expert defense is when it comes to speed measurements – especially for novice drivers during their probationary period. What initially threatened to be a serious A offense with considerable consequences was reduced to a simple B offense thanks to our work.
