Successful discontinuation of proceedings due to statute of limitations in fine proceedings

Local court Gemünden a. Main, decision of 29.08.2025, Ref. 1 OWi 972 Js 8098/25

Our law firm was able to achieve a significant success for our client in a current fine case before the Gemünden am Main Local Court: The proceedings were discontinued due to the statute of limitations pursuant to Section 206a StPO. The costs of the proceedings as well as the necessary expenses of our client were imposed on the state treasury.

What had happened?

Our client was confronted with a fine for allegedly exceeding the speed limit in a built-up area. Despite the accusations made and the initiation of fine proceedings, we were able to show in our defense that the statute of limitations had expired. The court followed our arguments and discontinued the proceedings.

Significance for those affected

The decision shows how important it is to carefully examine the limitation periods in administrative offense law. It is not uncommon for fine proceedings to continue despite expired time limits. With a committed defense, those affected can protect their rights and avert unjustified sanctions.
