Driving ban lifted after traffic accident – accusation of turning without allowing an oncoming vehicle to pass
Our client was fined by the Bavarian Administrative Office for turning off without allowing an oncoming vehicle to pass; an accident then occurred. A fine of €170 and a driving ban of one month were imposed. This is the standard penalty following the recent changes to the law.
Due to the minor fault of our client, the particular personal hardship in the case of a driving ban (care degree 2 of his wife and the associated need for constant access to a vehicle), high damage to his own car and no entries in the FAER, we were ultimately able to convince the district court to refrain from the driving ban and only slightly increase the fine to € 250.
This prevented a serious and excessive burden on our client.
