Restriction of the driving ban to vehicles of driving license class B
Our client was accused of exceeding the speed limit outside built-up areas by 55 km/h with a passenger car.
The accusation itself – in particular due to the high overrun – could not be dispelled. However, our client is professionally dependent on truck driving. We were therefore able to demonstrate to the court that, with an unrestricted driving ban, he would no longer be able to continue his professional activity. The court therefore limited the driving ban to vehicles in driving license class B (i.e. passenger cars and below), so that our client’s economic existence could be secured. There was also no increase in the fine.
Especially in the case of an impending driving ban, it is therefore always advisable to have the preconditions for waiving the driving ban or at least a restriction checked.
